NeoResus website Terms of use
NeoResus training programs are provided by the Paediatric Infant Perinatal Emergency Retrieval Service, a department of The Royal Children’s Hospital (ABN 35 655 720 546).
This website and its component parts (NeoResus Site) are established and maintained by RCH. By visiting, registering for, or using the NeoResus Site, you agree to be bound by and abide by the Terms of Use of the RCH’s website available at https://www.rch.org.au/rch/about/terms-and-conditions as though a reference to ‘the Site’ in those Terms of Use is a reference to the NeoResus Site.
In some cases, the terms of use of the NeoResus Site, include, and are supplemented by, other terms and conditions more specific to the use of a particular part of the site, or to goods or services provided by NeoResus. In the case of any inconsistency, the specific NeoResus terms and conditions prevail over the RCH Terms of Use.
Program and quiz terms and conditions
NeoResus training is provided by the Paediatric Infant Perinatal Emergency Retrieval Service, a department of The Royal Children’s Hospital (ABN 35 655 720 546). The programs provided at the time of publication of these terms and conditions are The First Response, Advanced Resuscitation and Facilitator workshops (Programs). NeoResus also provides an online multiple choice quiz to test participants’ understanding of the key concepts of newborn resuscitation (Quiz). The option of completing a Quiz based on the NeoResus open access learning resources is also provided.
By booking a Program or completing the Quiz you agree to the following terms and conditions:
- Eligibility and Pre-requisites
- By booking a Program and/or completing the Quiz, you warrant that you have the appropriate clinical background and:
- meet any eligibility criteria set out on this website required for attendance at the selected Program;
- will complete any pre-requisite reading and online training prior to attending the training;
- By booking a Program and/or completing the Quiz, you warrant that you have the appropriate clinical background and:
- Booking and payment
- Privacy
- The RCH will collect, use and disclose any personal information provided by in accordance with its privacy policy which is available at: https://www.rch.org.au/rchhis/privacy/.
- Liability
- You accept that, to the maximum extent permitted by law and except as expressly provided in these terms and conditions, RCH has not made any and hereby excludes all warranties, terms, conditions or undertakings, whether express or implied, written or oral, statutory or otherwise including any implied warranty of merchantability or of fitness for a particular purpose of the Programs or the Quiz.
- RCH and its officers, employees, contractors and agents will not be liable for any indirect, special, incidental or consequential damages or loss (including damages for loss of business, loss of profits, interruption of service or the like) whether based in contract, tort (including negligence), or product liability, arising out of the Programs or the Quiz.
- Either Party’s liability for any claim relating to the Programs or the Quiz will be reduced to the extent to which the other Party contributed to the damage arising from the claim.
- To the full extent permitted by law, RCH’s maximum cumulative liability to you in relation to the Program or the Quiz, regardless of the basis of the claim or action, including negligence, will in no event exceed the total amount of the fees paid by you to RCH.
- You indemnify RCH (including the RCH’s officers, employees, agents and contractors) (“those indemnified”) against all claims, costs, liability and expenses (including legal expenses) incurred by those indemnified as a result of any use or reliance on the Programs or the Quiz by you or the Permitted Users including any claim made against those indemnified by third parties.
- Without limiting the generality of the foregoing, you acknowledge and agree that:
- the Programs and the Quiz are provided for training purposes only and you remain entirely responsible for the health services you provide to your patients;
- the training provided in the Programs and the Quiz is not a substitute for the exercise by you of your professional judgment and the discharge by you of your professional duty to have regard to the clinical requirements of each individual situation and treatment; and
- RCH accepts no liability for any injury or death resulting from your misinterpretation of or default in the application of the training provided by NeoResus.
